Аннотация

Рассматривается историко-правовой аспект процесса трансформации Версальской системы в Версальско-Локарнскую. Та-лассократический капитал, используя в качестве рычага «план Дауэса», навязал европейским странам так называемый гарантийный пакт. Коллективная гарантия стран во главе с Англией охватывала только западные границы Германии, делая их неприкосновенными. Восточные же подлежали урегулированию посредством арбитражных договоров на основе ст. 19 Устава Лиги Наций, открывая путь на Восток.

On the creation of a legal mechanism for "pushing" Germany to the East in 1925

Abstract

The aim of this paper is to study the process of forming and revealing the essence of the legal mechanism for "pushing" Germany on to the East, which was established in 1925 as a result of the decisions of the Locarno Conference. The source is the historiography of the Soviet period, in which the terms "legal mechanism" and "Versailles-Locarno system" have not been previously used. The final documents of the Paris Peace Conference formed the so-called Versailles international legal system, which by definition was spearheaded against the Soviet Russia. Among other things, that system obliged Germany to pay large monetary reparations for winner countries and defined new borders of the states, but Article 19 of the Charter of the League of Nations provided for the change of state borders peacefully. At the same time it was assumed that with time the Versailles system would be supplemented by a system of guarantees. Initially, the possible scenario was dictated by the desire of Britain and France to divide Soviet Russia into spheres of their influence; however, after the collapse of these intentions, the initiative was captured by British diplomacy. Its secret memorandum contained a veiled program of action for the near future in the European international scene. Winners and losers were to conspire against Moscow, sacrificing the interests of small countries - Poland and Czechoslovakia. Britain was to direct the process. A favorable moment for the beginning of the program implementation came in 1923, when France was facing the threat of isolation in connection with the occupation of Ruhr after Germany delayed its payment of reparations. London came to help Berlin, the so-called "Committee of Experts" was established, which soon began to literally impose its will on European governments, including Paris. This became possible because the "Committee" was thalassocratic at its core and in its composition, i.e. it was represented by financiers from England and the United States, to whom France had debts after the First World War. This fact favored the implementation of the planned scenario - an international conspiracy against the Soviet Union. Its essence was to supplement the Versailles system with a system of warranties that would include a legal mechanism for pushing Germany to the East. Director of the Bank of England M. Norman and director of the Federal Reserve System of the US B. Strong played an important role. The legal registration of the conspiracy against the Soviet Union took place at the Locarno Conference in October 1925, when a number of international legal documents were initialed. A subject for unconditional execution was the so-called Rhine Pact, i.e. the guarantee agreement between Germany, Belgium, France, Great Britain and Italy. It made the western border of Germany immutable. Poland and Czechoslovakia were not included in the Rhine Pact; therefore, they did not fall under the collective guarantee of countries led by London. Instead, they signed arbitration contracts, which obliged Warsaw and Prague to regulate the border with Germany, thus opening its way to the East. Thus, the Versailles system was supplemented by a guarantee system, and became the Versailles-Locarno one, which also included a legal mechanism for pushing Germany to the East. The role of an arbitrator was reserved by the United Kingdom.
