Представительство федеративных государств в Совете ЕС: роль регионов

Аннотация

Статья посвящена анализу практики делегирования представительства стран ЕС в Совете Европейского Союза регионам. Рассматриваются происхождение этой нормы и ее реализация тремя входящими в ЕС федеративными государствами. Делается вывод о том, что эта норма широко применяется Бельгией, в узких сферах - Германией и не работает в Австрии. Соответственно, появление этой новации в праве ЕС, казавшейся в свое время важным шагом на пути к «Европе регионов», на практике не сыграло значительной роли.

Representation of federal states in the Council of the EU: roles of the regions

Abstract

The article focuses on the practice of delegating the nation states' representation in the Council of the EU to ministers of regional governments. Both the relevant norm itself and the specifics of its implementation in three EU's federal states, Germany, Austria and Belgium, are analyzed. The introduction of the norm allowing a state to be represented in the Council of the EU by a regional official into the Maastricht Treaty was initiated by Germany and was a reaction to the expansion of the EU's prerogatives into the areas where the Federation and the Laender shared competence or the Laender had exclusive competence. The legal innovation codified the practice that had existed since the late 1980s when the German government began to include the representatives of the Laender into the national delegation when the Council debated the issues falling under the competence of the Federation units. The analysis shows that Germany's representation in the Council must be delegated to a minister of a Land government if questions of school education, culture and television or radio communication are considered. The representative has to express the collective position of the Laender. In other areas touching the prerogatives of the Laender the position of the state is determined by the Bundesrat, the upper chamber of the Parliament which represents the Federation units. In any case the Laender have to act collectively to make a decisive influence on Germany's position in the Council. Similar procedures exist in Austria. However, the norm allowing for the delegation of the country's representation in the Council to a regional minister is not applied in practical policy. In Belgium there is a complicated system for the formulation of the country's position in the Council where the Federation and the regions and communities are essentially equal. Accordingly, each region or community of Belgium can make an individual impact on the working out of the national position. The delegation of Belgium's representation to regions and communities is practiced widely, with rotation being the underlying principle. The article concludes that in fact the norm introduced by the Maastricht Treaty has not become a major step to the expansion of regional participation in the EU's decision-making. Member states have retained control over the access of regions to this process and the formulation of national positions, the Belgian case being an exception reflecting a unique status that the country's regions have in the present-day Europe.
