Уголовно-правовые идеи Питирима Сорокина

Аннотация

Рассматриваются основные идеи, изложенные в книге П. А. Сорокина «Преступление и кара, подвиг и награда», а именно: о законодательном подходе к определению преступления, о связи преступления и наказания, об эволюции наказания, о неодинаковом влиянии наказания на поведение людей, о праве наказания. Критикуется обоснование исследователем формального законодательного подхода к определению преступления. Показано значение исследования для современной науки уголовного права и законодательной практики.

Pitirim Sorokin's ideas on criminal law

Abstract

The objective of the authors in writing the article was to analyze the main approaches of Pitirim Sorokin to the key categories of criminal law: crime and punishment. In the work on the article the following methods were used: analysis, synthesis, analogy, formal-logical, historical, logical-language and comparative law. The subject of the article is the main ideas contained in Sorokin's work Crime and Punishment, Feat and Reward. The book was written more than a hundred years ago, in 1913. It addresses issues related to the nature of social behavior, the classification of acts of behavior, the definition of crime and feat, punishment and reward, the impact of punishments and rewards on human behavior, trends in punishments and rewards, etc. The issues Sorokin considered in the book are relevant at the present time. The study showed that the main ideas of Sorokin were based on a justification of a formal legislative approach to the definition of a crime, a disclosure of the connection between crime and punishment, as well as a description of the evolution of punishment and the argumentation of the unequal impact of punishment on people's behavior. The authors of the article criticize Sorokin's position that the basis of legal recognition of acts as crimes is the pattern of a proper behavior of the dominant part of society. The article states that criminalization of an act is based primarily on the essential property of a crime associated with the violation of the most important social values necessary for the existence of the whole society. It is established that Sorokin interprets the connection between crime and punishment as the connection between cause and effect. This connection consists in the fact that punishment is punitive (it is retribution for a crime, this retribution is essentially equivalent to a crime, punishment causes suffering), it impacts the repeatability of criminal behavior, the nature of a crime affects the right of punishment. Talion is of great importance in the article. According to Sorokin, the evolution of criminal punishment began with this principle, which was connected with the limitation of punishment by the intensity and number of persons to be punished. The article shows the significance of So-rokin's research for the modern science of criminal law. It is argued that the perception of a number of ideas of the researcher by the modern legislator will allow to restore the essential property of punishment - its punitive character, which distinguishes punishment from other criminal law measures. It will also allow to give the list of punishments contained in Art. 44 of the Criminal Code of the Russian Federation the property of a system based on the severity of punitive effects of each punishment on the perpetrator.
