Аннотация

В последние годы всё большее внимание уделяется большим данным и их использованию. Умение не только собрать большие массивы данных, но и проанализировать их, даёт оператору, применяющему методы искусственного интеллекта к большим данным, невиданные ранее возможности. Появляются всё новые методы анализа, в том числе и предиктивного, которые позволяют с большой долей вероятности предсказывать определённые события. С развитием подобных технологий растут и возможности их применения в самых разных областях человеческой жизнедеятельности. И хотя в большинстве случаев предиктивная аналитика используется в коммерческих целях, существуют и прецеденты использования подобных методов анализа и прогнозирования в иных целях, в том числе и правоохранительных. Использование методов предиктивной аналитики позволяет правоохранительным органам узнавать о готовящихся преступлениях и, в некоторых случаях, даже предсказывать отдельные преступления. Подобные технологии способны значительно повысить возможности профилактики преступности. Однако в большинстве стран мира правовое регулирование использования предиктивной аналитики находится лишь на этапе становления, отставая от развития самих технологий. Такое несоответствие ведёт к неопределённости в возможностях использования данных, полученных путём применения предиктивной аналитики, которыми обладают правоохранительные органы. Зачастую, даже обладая данными, полученными путём предиктивного анализа, которые дают основания с большой долей вероятности полагать, что определённое лицо готовится совершить преступление, правоохранительные органы не имеют ни малейшей возможности повлиять на это лицо. Настоящая статья посвящена исследованию отдельных правовых аспектов использования предиктивной аналитики в правоохранительной деятельности. В статье рассматривается предиктивная аналитика в её широком понимании, существующие возможности её использования в правоохранительной деятельности. Помимо этого изучаются основные подходы к правовому регулированию использования предиктивной аналитики, сложившиеся в мире за последние годы. Особое внимание в статье уделено тому, как российские правоохранительные органы могут использовать предсказания о преступлениях, данные предиктивными алгоритмами.

LEGAL ASPECTS OF PREDICTIVE ANALYTICS APPLICATION IN LAW ENFORCEMENT

Abstract

In recent years more attention has been paid to big data and its use. The big data operator that uses AI with an ability not only to collect it, but also to analyze it, has unprecedented opportunities. New methods of analysis arise, including predictive ones, which make it possible to predict certain events with a high degree of probability. With the development of such technologies, the possibilities of their application in various fields of human life are growing. And although in most cases predictive analytics is used for commercial purposes, there are precedents for using similar methods of analysis and forecasting for other purposes, including law enforcement. The use of predictive analytic techniques allows law enforcement agencies to learn about impending crimes and, in some cases, even to predict crimes. Such technologies can significantly improve the prevention of crime. However, in most countries of the world, the legal regulation of predictive analytics is only in its formative stage, lagging behind the development of technologies. Such a discrepancy leads to uncertainty in the possibilities of using data obtained through the use of predictive analytics possessed by law enforcement agencies. Often, even with the data obtained by the predictive analysis, which gives grounds to believe that a certain person is preparing to commit a crime, law enforcement agencies do not have the slightest possibility to influence this person. The present article analyzes certain legal aspects of the use of predictive analytics in law enforcement. The author examines the predictive analytics in its broad sense, as well as the existing possibilities of its use in law enforcement. In addition, the basic approaches to the legal regulation of the use of predictive analytics that have taken shape in the world in recent years are being studied. Lastly, the article focuses on how Russian law enforcement agencies can use crime predictions given by the predictive algorithms.
